How Much Hip Injury Compensation Could I Get?

How much hip injury compensation you could get will depend on the severity of the injury and if you incurred any expenses. For example, extensive fractures of the pelvis along with a ruptured bladder could be awarded £95,680 to £159,770; whereas a minor soft tissue injury with a complete recovery could be awarded up to £4,820. These figures only apply to the actual pain and suffering caused by the injury and were taken from the Judicial College Guidelines (JCG). These guidelines provide suggested compensation brackets based on the injury type and severity and may be used by legal professionals, such as a solicitor, to value personal injury claims.

The table below gives some examples of the suggested amounts of compensation to be awarded to different types and severities of hip injuries by the JCG. These figures are just suggested values and therefore you are not guaranteed to receive these exact amounts. It should also be explained that the first figure in the table was not taken from the JCG.

What Factors Will Determine The Value Of A Hip Injury?

2 different factors will determine the value of a hip injury claim: general and special damages. Your hip injury compensation will be calculated using these 2 heads of claim:

  • General damages refer to the amount that you will receive for the suffering that you underwent from your hip injury. The more severe your hip injury, the more of an effect it will have on your day-to-day life, therefore your compensation will be higher. For example, a hip injury resulting in paralysis, where the victim can no longer play their favourite sport, will receive higher compensation than a fractured hip that will make a full recovery within two years.
  • Special damages refer to the expenses incurred as a result of the injury. We explore this head of claim in the section below.

Get in touch with an advisor to discuss your potential compensation. They can provide a free estimate that will consider multiple injuries as well as any related expenses.

Can Hip Injury Compensation Claims Cover Special Damages?

Yes, hip injury compensation claims can cover special damages. Special damages are awarded to compensate you for any other expenses that you have paid out to help with the recovery of your hip. These expenses will fall under the head of claim, ‘special damages’, and they will include things such as;

  • Travel costs – You may have had to pay taxi fares to and from medical appointments because your hip injury has left you unable to drive. Keep records and receipts of these journeys.
  • Care costs – A hip injury would make it very difficult to get around your home by yourself, therefore you may have had to hire help. Keep copies of invoices showing payment to carers.
  • Home adjustments – You may also need to make adjustments to your home to help you get around after your hip injury. This could include railings to hold on to as you walk around. Receipts for these adjustments should be kept to prove what you are owed under special damages.
  • Loss of earnings – A broken hip is likely to leave you with low mobility for a number of weeks, meaning you will be unable to attend work. This may result in you losing out on your usual monthly wages. Your payslips can help prove how much loss of earnings you experienced.
  • Medical Equipment – Your damaged hip will probably require support to walk around such as crutches and a wheelchair. There are instances where this equipment is not supplied by the NHS and therefore you may have to hire this yourself. Make sure you keep the receipts if so.

Contact us today to discuss what special damages you may receive and what evidence you will need to recover these costs.

Can I Make A Claim For An Injured Hip?

Yes, you can make a claim for an injured hip. However, before making your hip injury claim, you must first check that you are eligible. The eligibility criteria that you must meet is set out below.

  • Duty of Care – If you have injured your hip, you can only claim if someone else had a responsibility to ensure your health and safety, known as a duty of care. This may be an employer who has a duty to maintain any trip hazards so their employees don’t fall and dislocate their hip.
  • Breach – So your employer has failed to maintain these slip hazards and you have suffered a broken hip? Or, you were cycling on the roads and a driver failed to check their mirrors because they were using their mobile phone. They’ve hit you, resulting in hip and pelvis injuries. In both situations, the third party has breached their duty because they have failed to take all reasonable steps to ensure that your hip is not damaged.
  • Injury – Your damaged hip is the final piece of criteria that you need to prove to meet eligibility. Keep medical records and reports to prove what damage to your hip was done and how it happened.

What Accidents Could Lead To A Hip Sustaining An Injury?

Hip injuries can be sustained in a number of different types of accidents, all of which can lead to differing degrees of severity. Some examples of incidents that can lead to hip injuries are discussed below:

Workplace Hip Injury Compensation

A hip injury in the workplace can arise in many different ways no matter what sector you are in. You may work in an office setting where a slip hazard has not been signposted causing you to fall and fracture your hip. More serious hip injuries may take place in factories where a machine has not had its usual risk assessments and malfunctioned causing a crush.

You can learn more about accident at work claims by reading our dedicated guide.

Road Traffic Accident Hip Injury Claims

Another common cause of hip injuries is road traffic accidents (RTAs). You may be a pedestrian who has been walking in a crossing but a driver was not adhering to speed limits and did not brake in time before colliding with you. You now have a dislocated hip. Or, in turn, another driver collides with you because they were using their mobile phone and did not notice a stop sign before hitting you, breaking your hip.

Our dedicated road traffic accidents guide can help if you sustained a hip injury while using the roads.

Hip Injury In A Public Place Compensation

It may be difficult to know who is responsible for a hip injury in a public place, but the operators of these places owe the public a duty of care. For example, you have been in a supermarket and a box of stock has not been pushed to the back of a shelf safely, therefore it falls on you and crushes your hip. Or a pint has been spilt in a pub and as you are entering, you slip because there was no wet floor sign. The owners of these public spaces would be liable and you can claim.

Please see our dedicated public liability claims to learn more about claiming for accidents in public spaces.

Medical Negligence Caused Hip Injury Compensation

There are a number of different ways medical negligence can occur. The main point is to prove that a healthcare professional provided substandard care resulting in damage or further harm to your hip. So, you have undergone surgery for a hip replacement, but the doctor has operated on the wrong side of your hip, disabling you and leaving you in more pain than what you were in prior to your operation? Your doctor would be medically negligent and you have grounds to claim against them.

Our medical negligence guide can tell you more about claiming for negligent treatment leading to a hip injury.

If you want to discuss the circumstances that led to your hip injury to find out whether you could receive compensation, call us today.

What Evidence Will Support A Hip Injury Compensation Claim?

Evidence that may support a hip injury compensation claim will include items that prove liability for the accident as well as proof that you suffered an injury. It is important that you gather as much evidence as possible to give you the best possible chance of success and to receive the fairest compensation amount. Some examples of evidence that you should begin to compile include:

  • Medical evidence – This could include up to date medical records that include details of your hip injury and its severity supported by X-rays, scans and any surgery that you have had to undergo.
  • Receipts – Receipts of prescriptions for medication, such as painkillers, to help with the recovery of your hip will stand as supporting evidence.
  • Photo/video evidence – CCTV footage of the accident that caused your hip injury, or dashcam footage for an RTA, as well as images of the scene, are strong evidence.
  • Witness contact details – Anyone who witnessed the accident take place and can testify that someone else was at fault, take note of their contact details so they can be contacted by your solicitor during the claims process.
  • Reports – If you injured your hip at work, make sure that it has been reported in the accident report book, detailing how the accident happened and the injury on your hip that was sustained. If police attended the scene (such as for a road traffic accident) ensure that they have taken a similar report of the incident.

For more information on what evidence to begin compiling to support your claim, read our detailed guide on evidence for a personal injury claim

Alternatively, you can contact us and discuss this with an advisor today.

How Long After A Hip Injury Can I Make A Claim?

Generally, for any personal injury claim, you will have 3 years to begin making your claim. This time limit begins from the date that the accident took place and the injured hip was sustained. There are some exceptions to this time limit, which are described in depth in our dedicated limitation period guide.
