Can I Claim Finger Injury Compensation?

Yes, you could claim finger injury compensation if you can demonstrate that your injuries were caused by a third party’s negligence. In doing this, you must be able to fulfil the following eligibility requirements:

  1. You Were Owed a Duty of Care

Another person, business, or organisation must have owed you a legal duty of care. This essentially means that they were responsible for taking reasonable steps to protect your health and safety in the situation where the injury occurred.

  1. That Duty of Care Was Breached

Following this, you must prove that the duty of care was breached. A breach may happen when a third party falls short of expectation, and does not act how a person or organisation reasonably would have done. Examples may include failing to train staff members, ignoring risks and hazards, and failing to adapt safety measures.

  1. You Suffered an Injury or Illness

You must have suffered a physical or a psychological injury to be eligible to claim. This can range from minor injuries to more serious or long-term conditions, such as fractures, dislocations or a loss of a finger.

What Accidents Can Lead To A Finger Becoming Injured?

There are many accidents that can lead to a finger becoming injured, namely at work, on roads, in public, or in healthcare settings. Please see the following examples and how finger injury compensation claims could arise as a result:

Accident At Work

Employers have a duty of care to take reasonable steps to ensure the safety of their staff. A failure to do this could amount to a breach in a duty of care, resulting in accidents and subsequent injuries to workers. For instance:

  • Your employer could fail to repair a cutting machine, despite being aware that it needs fixing. The machine could malfunction whilst you’re using it, resulting in serious deep cuts to multiple fingers from the circular saw.
  • An employer could fail to provide you with the adequate personal protective equipment (PPE) such as gloves when using powered hand tools. Due to this, a moving part could cut your hand, leading to permanent scarring and psychological injuries such as PTSD.

If you’ve experienced something similar, you could make an accident at work claim due to your employer’s negligence.

Accident In Public

Those in control of public places have a duty of care to take steps in ensuring the reasonable safety of visitors to their premises. Nevertheless, you could make a public liability claim if a third party breached this duty of care, resulting in your finger injuries. For example:

  • A council could fail to fix a broken piece of pavement, despite being made aware of it by numerous sources. You could trip and fall, resulting in several fingers to become dislocated on your left hand.
  • The owner of a shop could fail to fix a broken automatic door that has been malfunctioning. The door could suddenly close on your hand, resulting in crush injuries to several fingers from being trapped.

Road Traffic Accident

All road users owe a duty to one another to navigate the roads in a safe manner that prevents injury to themselves and others. If this standard is not upheld, you could make a road traffic accident claim if a driver was negligent. To illustrate:

  • A driver could be using their mobile phone, failing to notice you navigating a zebra crossing. The driver could hit you, resulting in several broken finger injuries, a broken arm and a dislocated neck.
  • A driver could fail to break in time with changing traffic lights, resulting in a rear-end collision. Due to the force, you could suffer crush injuries to your fingers from hitting the steering wheel. Further to this, you could also suffer with whiplash and lower back injuries.

Medical Negligence

All healthcare professionals have a duty of care to their patients. In doing this, healthcare professionals must meet the minimum expected standard of care when providing treatment. However, if you’ve suffered harm to your finger due to substandard treatment, you could make a medical negligence claim. For instance:

  • You could suffer a surgical error whilst receiving carpal tunnel release surgery. For example, a surgeon could use excessive force with a scalpel, resulting in permanent nerve damage and a loss of sensation in two fingers.
  • You could attend A&E with a broken finger, requiring immediate treatment. A consultant could fail to secure your finger properly in a cast, causing it to heal in a deformed position. You could suffer psychological injuries as a result, such as PTSD, anxiety and depression.

Evidence Needed To Prove Liability For A Finger Injury

To prove liability for a finger injury, you will need to demonstrate that your injuries resulted from negligence. In doing this, you could provide the following forms of evidence:

  • A copy of your medical records to support the injuries you suffered
  • CCTV or dashcam footage of the incident
  • A copy of an accident report form, detailing the incident
  • Contact details of witnesses who could support your version of events at a later date
  • Photographs of visual injuries
  • A daily symptoms diary, detailing the severity of your injuries and any treatment you received
  • The registration and insurance details of the third party if you were involved in a road traffic collision

How Long After I Injured My Finger Can I Make A Claim?

You can make a claim within 3 years of your finger injury as per the Limitation Act 1980.

However, the following exceptions to the Act may apply to your situation:

  • If the claimant is a child, the 3-year time limit will begin from the date of their 18th birthday.
  • Where an injured person lacks mental capacity, the usual 3-year time limit for making a claim is suspended. The time limit will begin only when they regain mental capacity. Until then, a claim can be made on their behalf by a litigation friend.

For more information about limitation periods, please see our dedicated guide on the compensation claims time limit.
