Can I Make A Compensation Claim For An Injured Wrist?

Yes, you could make a compensation claim for an injured wrist. The first step is checking your eligibility. To be eligible to make a claim, there are three pieces of criteria that you must meet. 

  • You Were Owed A Duty Of Care 

Either another person, business or organisation must have owed you a legal duty of care. Therefore, it was their responsibility to ensure that they had taken reasonable steps in ensuring your health and safety in the situation where the injury occurred. So, for example, as an employee, it is your employer that owes you a duty of care. If you are a patient, it is your doctor that owes you a duty of care. 

  • The Duty Of Care Was Breached 

Once you have proven that you were owed a duty of care, you must then be able to prove that this duty of care was breached. This happens when the responsible party has failed to take all reasonable measures to ensure your health and safety and this has therefore resulted in injury. This breach may have happened by the party ignoring safety rules and failing to fix or signpost any hazards such as a wet floor. 

  • You Suffered An Injury Or Illness 

The final criterion that must be met for you to be eligible to make a claim is that you must be able to prove that you have suffered a physical or mental injury due to the breach. For a wrist injury, evidence such as medical records would be sufficient in proving this.

How Much Wrist Injury Compensation Could I Get?

How much compensation you could be awarded for a wrist injury will depend on the severity, whether you suffered additional injuries and if you incurred any related expenses. For example, a very severe wrist injury could be compensated up to £73,050 (for the injury alone); whereas a very minor, undisplaced fracture may see an award of £4,370. There are two types of damages that you can be compensated for with a successful wrist injury claim. All successful personal injury claims receive general damages as compensation for their injury to cover the suffering and pain endured throughout the accident and recovery period. Legal professionals will refer to the Judicial College Guidelines (JCG) to help them to calculate general damages for each case. The JCG helps to give a baseline of what compensation should be awarded depending on the type and severity of the injury sustained.

Can Financial Losses Be Claimed as Part of Wrist Injury Claims?

As well as general damages, a successful claim may also be awarded special damages. These are to recover any additional costs and expenses that are associated with the injury and would not have been lost had the injury not taken place. These can include: 

  • Cost of care 
  • Travel expenses to attend medical appointments 
  • Adjustments that had to be made to the home 
  • Loss of wages from not being able to attend work due to the nature of the injury. It can also make up the difference between sick pay and what your wage would have been.
